By using Busker, you agree to these terms. Please read them carefully. Some subjects have their own detailed terms that form part of this agreement — our Payments & Fees terms and our Privacy Policy.

1. Acceptance of Terms

By accessing or using Busker ("the Service"), you agree to be bound by these Terms of Service and the additional terms they reference. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Busker is a platform that helps YouTube and social-media creators build and own an audience. Depending on the features a creator enables, the Service lets creators run subscriber-verified giveaways, sell products through a storefront, offer paid membership tiers, accept tips, send newsletters and publish posts, collect survey and ask-box responses, send new-video alerts, and publish a public link page. Followers and members take part by signing in with Google, and Busker verifies YouTube subscription status where a creator chooses to gate a feature on it. The Service is provided "as is" and may be modified at any time.

3. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

4. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Run fraudulent or deceptive giveaways, sales, promotions, or solicitations
• Sell or promote unlawful, counterfeit, infringing, or otherwise prohibited goods
• Send unsolicited bulk email or use the newsletter and messaging tools to spam
• Collect personal information for unauthorized purposes
• Infringe the intellectual property or other rights of others
• Interfere with the operation of the Service
• Attempt to access accounts or data belonging to others

5. Creator Responsibilities

You are responsible for how you use each feature you enable. In particular:

• Giveaways: Comply with all laws governing contests and sweepstakes, provide accurate giveaway information, fulfill prizes to winners, and handle disputes with participants. Entering a giveaway must always be free — see Section 8 of the Payments & Fees terms. By entering a giveaway, you agree that if you're selected as a winner, your YouTube handle and channel avatar may be displayed publicly on the giveaway page to announce the result.
• Storefront: You are the seller of record for the products you sell. You are responsible for accurate listings, fulfilling and shipping orders, your own refund policy, and any applicable taxes.
• Memberships: Describe your tiers and perks accurately and deliver what you promise. Recurring billing is governed by the Payments & Fees terms.
• Tip Jar: Tips are voluntary contributions; you should not promise goods or services in return for a tip unless you clearly say so.
• Newsletters and communications: Only contact people who joined your list through legitimate means, honor unsubscribe requests promptly, and do not send spam or unlawful content. You are responsible for what you send.
• Surveys, ask box, and comments: You control what you collect and publish. Do not request sensitive information you do not need, and moderate the content you make public.

6. Payments and Fees

Busker charges a platform fee and processes payments through Stripe. Creator subscription billing, store, membership, and tip payments, payouts, refunds, taxes, and chargebacks are governed by our Payments & Fees terms, which form part of these Terms.

7. User Content

You retain ownership of the content you create through the Service — giveaway details, products, posts, newsletters, and similar material. You grant Busker a limited, non-exclusive license to host, store, display, and transmit that content as necessary to operate and provide the Service. You are responsible for having the rights to the content you upload and for ensuring it does not violate the law or the rights of others.

8. Privacy and Data

Your use of the Service is also governed by our Privacy Policy. By using Busker, you consent to the collection and use of information as described in that policy. The fan contacts you collect are yours: you can export them at any time, and we do not sell them.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Busker and are protected by international copyright, trademark, and other intellectual property laws.

10. Termination

We may terminate or suspend your account at any time, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may export your fan contacts before terminating your account.

11. Limitation of Liability

In no event shall Busker, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Because creators are the seller of record for their own products, memberships, and tips, Busker is not responsible for transactions, fulfillment, or disputes between a creator and their buyers, members, or supporters.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new terms.
